Repeatedly said can't pay then disputed

The said they were unable to pay as their client had not paid them in full. During correspondence they said as soon as they were paid, my client would be paid. The dispute is in our opinion nothing more than a smokescreen to disguise the facts they have already stated - they can't pay the debt and examples of this correspondence are below. They have refused to pay the amount they admit and now claim that amount is even incorrect. David Anthony Hackett has been advised he is allowing the company to trade whilst insolvent, has been advised this will be reported to The Insolvency Service and simply replied "I look forward to hearing from yourselves, your client, CGA, solicitors and insolvency services accordingly." They even sated to our client that whilst they discussed extra works, they did not agree to them! This despite pushing to have said works completed. Further they refer to their clients as "F*****G C****S 01/06/2026, 13:15 - David Hackett: We are trying to lock in a final account meeting with them tomorrow with payment to be made Friday. As previously explained we can determine your final account after we have had our final account meeting. Be advised that they are currently only valuing our £49k val at £28k from memory” 07/05/2026, 08:10 - David Hackett: Stef. There is no money how else can I say it. . 16/06/2026, 09:35 - David Hackett: Hi Stef Irrespective of the meeting between Chris and yourself there are no funds available until CGA pay sorry David Anthony Hacket has also been advised of his obligations under the construction act to serve a payless notice which he has not done. He is also aware that pay when paid is prohibited. None of this makes any difference to him. Our client has now instructed Solicitors to pursue the debtor as they see fit.
